Terms of Service

1. Acceptance

By using the Services you confirm that you have read, understood and agree to these Terms. If you use the Services on behalf of an organisation you represent and warrant you have authority to bind that organisation.

2. Changes to the Terms

We may modify these Terms from time to time. Material changes will be posted on nekokoneko.org and — where feasible — notified to users in advance. Continued use after changes means you accept the updated Terms.

3. The Services — accounts & functionality

3.1 Accounts

• You may be required to create an account to use certain features. Provide accurate information and keep credentials secure.
• Linking services (for example, linking a Discord account to a Supremacy account via Manolo) requires sharing identifiers (Discord ID, Supremacy ID) to provide the linked functionality.

3.2 Service availability

We aim to keep the Services available but do not guarantee uninterrupted access. We may suspend or modify the Services for maintenance, security, or legal reasons.

4. Privacy, data protection & GDPR

Your use of the Services is subject to our Privacy Policy, which explains what personal data we collect, how we use it, lawful bases for processing, retention, transfers, and how you can exercise your rights (access, rectification, erasure, restriction, objection, portability, withdraw consent). The Privacy Policy also explains how to request deletion (email or Discord DM) and how we verify requests.

Data processing obligations

• We act as controller for the personal data described in the Privacy Policy. Where we engage processors (e.g. Discord, OVHcloud, Google Analytics) they process data on our instructions and we require appropriate safeguards.
• If you are in the EU/EEA, you have the rights set out in the Privacy Policy and may lodge a complaint with your national Data Protection Authority.

5. Acceptable use

You must not use the Services to:

• Break the law or infringe others’ rights;
• Attempt unauthorised access to our systems or other users’ accounts;
• Distribute malware, spam, or otherwise abuse the Services;
• Interfere with or disrupt the Services or servers.

We may suspend or terminate accounts that violate these rules.

6. Intellectual property

All content, code and infrastructure provided by LNN (excluding third-party content) are our property or used with permission. You may not copy, modify, distribute, or create derivative works without our written permission.

Third-party content (e.g. Supremacy 1914 artwork) is used under their copyright and does not indicate endorsement or affiliation. Respect third-party IP when using the Services.

7. Third parties

The Services integrate with third-party platforms (for example Discord, OVHcloud, Google). Use of such third-party services is subject to their terms and policies. We are not responsible for their practices. See the Privacy Policy for names of key processors and information about international transfers.

8. Warranties; limitation of liability

8.1 No warranty

The Services are provided “as is” and “as available.” LNN disclaims all warranties to the maximum extent permitted by law.

8.2 Limitation of liability

To the maximum extent permitted by applicable law, LNN (and its officers, employees and agents) will not be liable for indirect, incidental, special, consequential or punitive damages arising out of your use of the Services. Our aggregate liability for direct damages will not exceed the amount you paid (if any) to use the Services.

9. Indemnity

You agree to indemnify and hold LNN harmless from claims, damages, losses, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Services.

10. Termination

We may suspend or terminate your access for breaches of these Terms, illegal activity, or at our discretion. Upon termination your right to use the Services ends. Sections that by their nature survive termination (for example: intellectual property, limitation of liability, indemnity) remain in force.

11. Dispute resolution & governing law

These Terms are governed by the laws of Switzerland. If you are an EU/EEA resident, mandatory local consumer protection rules may apply. Where required by law, you may bring disputes before the competent courts or your local consumer dispute resolution body.

12. Changes to the Services

We may change, suspend, or discontinue the Services (or parts of them) at any time. We will try to give notice for material changes where feasible.

13. Feedback

Feedback you provide (bug reports, suggestions) is non-confidential and you grant LNN a perpetual, transferable, royalty-free license to use and adapt that feedback.

14. Miscellaneous

• Entire agreement: These Terms, together with any referenced policies (including the Privacy Policy), form the entire agreement between you and LNN regarding the Services.
• Severability: If any provision is invalid or unenforceable it will be severed and the remainder will remain in effect.
• No waiver: Failure to exercise a right is not a waiver of that right.
